NightShift Terms of Service

NightShift is for adults 18 and older only. Minors are prohibited. By using the Service you confirm that you are at least 18 years old (or the age of majority where you live, if higher) and legally able to enter into these Terms.

• Any account we believe belongs to someone under 18 is removed immediately, and we report it where applicable, including to the NCMEC CyberTipline.
• We may require age verification at any time, such as a selfie or government ID check through a third-party verification provider. If you do not complete verification, we may limit or close your account.
• If you believe a member is under 18, please use the in-app Report button or email support@joinnightshift.co right away.
• You may not use the Service if you have been convicted of a sexual offense or a violent crime, or if you were previously removed from the Service.

NightShift has zero tolerance for sex trafficking, prostitution or any other commercial sex, escort services, and soliciting or offering payment (money, gifts or anything of value) for sex. This includes advertising, arranging, or referring others to any of these activities, and "sugar" or "pay-to-meet" arrangements.

• Accounts involved in any of this are removed immediately and permanently, without warning or refund.
• We report suspected trafficking and child exploitation to, and cooperate with, law enforcement, including the National Center for Missing & Exploited Children (NCMEC) and the National Human Trafficking Hotline (1-888-373-7888).
• How to report: tap the Report button in any conversation, or email support@joinnightshift.co. If someone is in immediate danger, call 911 (or your local emergency number) first.

You are responsible for what you post and how you treat other members. You agree not to:

• Harass, threaten, stalk, bully or intimidate anyone, or keep contacting someone who has asked you to stop.
• Share intimate or sexual images of anyone without their consent, or any content involving minors.
• Impersonate anyone, use someone else's photos, or misrepresent your identity, age or relationship status.
• Post hate speech or content that attacks people based on race, ethnicity, religion, disability, sex, gender identity or sexual orientation.
• Post or promote illegal content or activity, including the sale of drugs or weapons.
• Send spam, run scams or romance fraud, ask members for money, or promote commercial services.
• Share another person's private information (address, phone number, workplace, photos) without permission.
• Upload explicit nudity or sexual acts in profile photos.
• Scrape, reverse-engineer, or interfere with the Service, or create accounts by automated means.

Consent matters. Every interaction on NightShift and any meeting arranged through it must be based on clear, ongoing, freely given consent. No means no, and consent can be withdrawn at any time.

Enforcement: we may remove content, warn you, suspend your account, or permanently ban you, at our discretion and with or without notice, for breaking these rules.

Some features require a paid membership. Current NightShift membership prices (USD): $49.99 every 3 months or $19.99 every month. Applicable taxes may be added. The price and billing period are shown before you confirm a purchase.

• Memberships are billed in advance at the start of each billing period.
• Your membership renews automatically at the same price for the same period until you cancel. By purchasing you authorize us to charge your payment method on each renewal.
• If we change the price of your membership, we will give you advance notice before the new price applies, and you can cancel before it takes effect.
• Charges appear on your statement under PACE or our payment processor's billing descriptor.
• Payments are handled by a third-party payment processor. We do not store your full card number.
• One-off purchases are also available: Boost (24 hours) for $19 and Direct messages (5-pack) for $24.95. These do not renew.

Women on NightShift may be offered free access to core features. We may change which features are free, with notice.

You can cancel at any time in the app: go to Profile > Membership > Cancel membership. You can also cancel by emailing support@joinnightshift.co from the email or phone number on your account.

• Cancellation takes effect at the end of your current paid period. You keep access until that date, and you will not be charged again.
• To avoid the next charge, cancel at least 24 hours before your renewal date.
• Deleting the app does not cancel your membership.
• Refunds: membership fees are non-refundable, except where required by law or for billing errors and duplicate charges reported to support@joinnightshift.co within 30 days of the charge.
• One-off purchases (Boost, message packs) are non-refundable once used.

• Some profiles on NightShift are AI characters ("AI Companions"). They are always labelled "AI", are not real people, and cannot meet you in person.
• Messages you send to an AI Companion are processed by a third-party AI model provider to generate replies.
• There is a free daily allowance of AI Companion messages. You can mute AI Companions at any time in your profile settings.
• AI Companions are never used to deceptively pressure or induce you into making a purchase.

We do not run criminal background checks on members and cannot verify everything people say about themselves. Use good judgement: meet in a public place, tell a friend where you are going, arrange your own transport, and never send money to someone you met on the Service. Report anything that feels wrong.

You can ask us to delete your account at any time by emailing support@joinnightshift.co. We may suspend or terminate your account at any time if we believe you have broken these Terms, the law, or put others at risk. If we terminate your account for a breach, you are not entitled to a refund of any fees.

The Service is provided "as is" and "as available" without warranties of any kind. We are not responsible for the conduct of any member, on or off the Service. To the maximum extent permitted by law, PACE will not be liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.

The governing law, venue and dispute-resolution process for these Terms are to be confirmed. Until then, please contact support@joinnightshift.co first so we can try to resolve any issue informally. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

We may update these Terms. If we make material changes we will notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
